Safety Element Review

Government Code (GC) 65302.5(b) requires the draft element of or draft amendment to the safety element of a county or a city's general plan be submitted to the State Board of Forestry and Fire Protection for any county that contains state responsibility areas or city or county that contains very high fire hazard severity zones. Safety elements must be submitted at least 90 days prior to the planned adoption or amendment of the safety element, although the Board encourages communities to submit their draft safety elements as early as possible in the planning process. The Board will review the safety element and respond with comments within 60 days from receipt of the safety element.

Submitted safety elements are reviewed against the appropriate version of the Safety Element Assessment (below), based on a city or county’s size, level of risk, and other existing fire protection planning efforts, among other considerations.

4290 Certification

Counties may submit their local fire safe ordinances relating to emergency access, signing and building numbering, private water supply reserves for emergency fire use, and vegetation modification to the Board of Forestry and Fire Protection for certification in lieu of Public Resources Code (PRC) 4290. This certification allows the local ordinances to be used in lieu of the PRC 4290 standards in state responsibility areas. CAL FIRE retains the authority to enforce the state standards in the SRA even when local ordinances have been certified by the Board.

The regulations that implement PRC 4290 are found in 14 CCR 1270 et seq. Local ordinances that are submitted to the Board for certification must meet or exceed the standards set in those regulations to be certified.

To submit local ordinances for certification, the ordinances as adopted by the County Board of Supervisors or other governing body and a cover letter requesting 4290 certification should be submitted electronically on a CD via mail to:
